
The article of the Criminal Code "Torture" was renamed to the article "Torment" in Azerbaijan. The article "Beating" was removed from the Criminal Code. It is included in the Code of Administrative Violations.
According to the additions and amendments to the Criminal Code, adopted at the last extraordinary meeting of the spring session of the Parliament on Friday, Article 133 "Torture" of the Criminal Code will be called "Torment" now.
While commenting on this change, chairman of the Parliamentary Committee on Legal Policy and State Building Ali Huseynli stressed that it is aimed at bringing the Azerbaijani Criminal Code in accordance with the UN Convention against Torture.
Accordingly, the penalty prescribed for this offense is reduced from three to two years.
The lower and upper limit of the punishment prescribed for this offense committed under aggravating circumstances has been reduced.
For example, according to the current legislation, the person who committed the crime under aggravating circumstances is sentenced for a term of 3 to 7 years. The approved change reduces the penalty for a period of 2-5 years.
The Azerbaijani Criminal Code is expected to be amended by including a special article for the torture, cruel, inhuman or degrading treatment.
This article applies if an official performing his official duties or other officials with his consent or at the instigation of his awareness humiliate or cruelly treat another person. The article envisages a fine worth 3,000-4,000 manat or a ban to hold office, as well as deprivation of a right to deal with this activity up to 3 years, or imprisonment for a term of 3 to 8 years.
