Chairman of Azerbaijan Supreme Court: "One of the shortcomings of Azerbaijan's court system is adoption of illiterate and unjust decisions"

Despite successful development, the court system still have numerous shortcomings in Azerbaijan, said chairman of Azerbaijan's Supreme Court, Ramiz Rzayev, speaking on the judicial system of the country.
"On the whole, these are such cases as violation of principles of court proceeding, failure of the parties to attend the trial and rude violation of their rights and adoption of illiterate and unjust decisions", said he voicing confidence that there will not be such problems in the very near future.

He explained that legal reforms continue in our country and stressed the importance of presidential decree of January 19 of 2006, regarding application of the law of Azerbaijan Republic "On modernization of the court system", aimed at raising effectiveness of courts, provision of rights and liberties of people and citizens, improvement of court system and consolidation of judicial power.

He also noted that great attention is paid to development and improvement of the court system in the country.

"This process was implemented under leadership of National Leader Heydar Aliyev. Today Azerbaijan is a jural state, which, basing on principles of a democratic, jural state, set a task to bring the country's legislation in compliance to the working Constitution of the country and international norms. A new legal system in Azerbaijan formed with adoption of laws, regularing activity of all law-enforcement bodies and courts of the republic", said Rzayev.

He noted that there are shortages in the activity of the courts, which are caused by objective and subjective reasones.

"Objective reasons are great number of cases, as well as the small number of judges. Subjective reasons are adoption of illegal decisions by the judges. This fact bewilders the administration of the Supreme Court greately.

A number of measures, such as raising the number of judges by way of careful and transparent selection of candidates to judges through transparent and unbiased exams, holding trainings and seminars with participation of international experts and lawyers on ensuring and strengthening of independence and impartiality of judges, are held for removing the said problems", noted the chairman.
