Two lawyers appeal to European Court against Azerbaijani Bar

Two Azerbaijani lawyers, Intigam Aliyev and Annagi Hajibayli, filed a claim to the European Court of Human Rights against the Azerbaijani Bar Association, according to the Legal Enlightenment Society.

Aliyev and Hajibayli consider Bar’s refusal to recognize their lawyer status as violation of several articles of the European Convention of Human Rights.

According to the claim, the Presidium of the Bar declined Intigam Aliyev's appeal on functioning as a lawyer at a meeting held on November 19, 2005 and Annagi Hajibayli on January 26, 2006.

“The Nasimi district court sent Intigam Aliyev’s appeal back, case on the appeal of Annagi Hajibayli ended,” they said.

According to the Society the Supreme Court abolished the court decisions on the case of the two lawyers at the end of 2007 after the conflicts in the courts which lasted more than a year and the cases were returned to the Nasimi district court for being investigated.

The Nasimi district court did not grant Hajibayli’s claim or consider Aliyev’s appeal.

Thus, the number of appeals to the European Court of Human Rights against Azerbaijani Bar regarding lawyers has reached 10.
