Fahmin Hajiyev satisfied with ECHR judgement

Former Commander of the Special Police Force and ex-prisoner Fahmin Hajiyev's lawyer Ganira Iskenderova gave a press conference in Baku.

The lawyer said that they filed a request with the European Court of Human Rights on January 21, 2003.

By a decision of 16 June 2005 the Court declared the application partly admissible, APA reports.

"Fahmin Hajiyev complained about violations of Article 6, 7 and 14 of the Convention for the Protection of Human Rights and Fundamental Freedoms. Article 7 was not taken into consideration he was released. The court passed a judgment on the case of Fahmin Hajiyev at last. The court concluded that there was a violation of Article 6 § 1 of the Convention. he had suffered discrimination, that the applicant suffered a restriction in his right of access to a court and, therefore, in his right to a fair trial, the respondent State is to pay the applicant EUR 3,000 (three thousand euros) in respect of non-pecuniary damage, plus any tax that may be chargeable; and EUR 2,500 (two thousand five hundred euros) in respect of the costs and expenses, less EUR 850 (eight hundred and fifty euros) granted by way of legal aid, plus any tax that may be chargeable," she said.

She also added that Fahmin Hajiyev is pleased with the decision.

"The Applicant is satisfied with the judgement, the Court reaffirmed that he was held in the prison groundlessly. But, Fahmin Hajiyev had claimed 17,000,000 euros (EUR) in respect of non pecuniary damage, on the ground that he had been unfairly convicted and was not given an opportunity to have the first-instance judgments reconsidered on appeal, and after he had been convicted, he was widely perceived in Azerbaijani society as one of the parties responsible for the Khojaly events," she said.

Ganira Isgandarova said that Fahmin Hajiyev is living in Turkey as a fugitive.
