Adil Ismayilov: “The judge put pressure on experts in Ramil Safarov’s trial”

Lawyer Adil Ismayilov, representative of parents of officer of Azerbaijani Army Ramil Safarov who is accused of murdering Armenian officer Gurgen Markaryan held a press conference yesterday.
Informing about the trail on Azerbaijani officer held in Budapest on 15 December, the lawyer said that two issues-listening to Azerbaijani officer Anar Aliyev’s testimony and announcing the opinion of the third examination were to be looked over in the trial: “Anar Aliyev cannot give a testimony in the court as he has some health problems. Therefore, his testimony give to the primary investigation was announced.

The opinion of the experts on the third medial examination made on Ramil Safarov was presented later on. It turned out that the psychologists concluded that Ramil Safarov was not conscious fully when he committed the case, short circuit happened in his brain before the event. This opinion didn’t differ from the second one so much.

According to Hungarian laws, the judge can reduce the murderer’s punishment without any restriction, thus, Ramil Safarov may be sentenced to 2-3 years of imprisonment”. The lawyer said that, the judge presiding the court was dissatisfied with the third opinion either and showed this by his behavior.

Stating that the judge puts pressure on the experts, the lawyer demonstrated a position obviously: “The judge had put three questions on the experts. These are: the difference between the previous two examinations, which of them is right, whether the next examination was needed. The experts said the misunderstand concerning the first examination was due to Ramil Safarov’s bad Russian language skill. His consciousness was shown as restricted in middle level while he committed the event. According to the latest opinion of experts this restriction was in sharp form. The judge was dissatisfied with these answers and he stated that he didn’t accept the last examination at all. Asking unnecessary questions to the experts, the judge told them as if they exceed their powers and appointed next examination later on”. The lawyer said that the judge’s demonstrating position caused concern. Therefore, the issue on protesting to the judge’s behavior was topical: “This issue is discussed at present, it depends on the final decision whether the judge will be protested to or not”.

A.Ismayilov also informed about Ramil Safarov’s appeal to the court with regard to the guards. According to the lawyer, the guards wanted his telephone card on June 19, 2004. Ramil Safarov who doesn’t know Hungarian did not understand them and therefore, problem appeared. 8 policemen imposed violence on him by tying his arms: “We decided to appeal to court after that. The opposite side raised a claim stating that he resisted the representative of the authorities. The case was put an end by our request. The claim of the guards on Ramil Safarov will be looked over on 17 January. I think, Ramil Savarov needs a lawyer with regard to this case. I will attend the process I have opportunity”.

The lawyer reminded that that Armenian press writes false information as if Azerbaijani side gave bribe to the experts: “I could say that Armenians gives bribe to the judge then. But I don’t say as I have no fact on this. I have more ground for saying this than Armenians. The judge’s behaviors prove this”.

Not expressing his dissatisfaction of the Hungarian lawyers’ activities, the lawyer said of the medical experts to have been objective so far. The lawyer hopes that the next opinion of experts will be objective too: “I think, it will be the final examination”.

A.Ismayilov also reminded that Azerbaijan and Hungary have joined the convention on extradition of the sentenced persons. According to him, Ramil Safarov might be extradited to Azerbaijan after having been sentenced.
