Barmek's suit against Taxes Ministry disclaimed in court

Huseyn Arabul, Barmek President, has noted that his company follows the rules of a contract signed between Azerbaijani Government. Saying there is a big problem with computation of technical losses, Arabul has added that this question must be dealt with upon calculations, APA informs.

"The Ministry of Economic Development has proved the loss normative that we have determined together with Energy Projecting Institute and The Academy of Sciences has recommended it to be true. Specialists from Turkey have also taken part in the process. Losses have been determined at 17,63% level which is on the contract."

Claiming that the Ministry of Taxes intends to put Barmek into more taxation, Mr. Arabul has declared that he will defend his rights till the end and will appeal at international court if necessary.

"I will continue my struggle till the end relying on both the contract and an interstate contract on investment protection. The decision adjudged herein is under the world's attention."

Mr. Arabul said that there had been no technical losses normative when he came to Azerbaijan. Then he gave the contract signed with the Government to court members.

"The paper has the signatures of Deputy Ministers, ministers of Economic Development, Taxes, Finance, Justice, departments’ chiefs in the Cabinet of ministers, OJSC Azerenergy and Baku Energy Network presidents and also the signature of the President."

Yashar Mammadov, a senior specialist in Energy Projecting Institute, has said that the calculation of Barmek figures is made wrong.

"The losses' normative for Barmek that we have determined was calculated according to its figures. We had no check-up for that. It is possible that energy losses deviate higher or lower due to intervals that were not considered in the preparation of the paper," he said.

All officers representing the Taxes Ministry have stated that they find Barmek President's claims groundless and the ministry has submitted all necessary documents to the court.

LLC Barmek-Azerbaijan Energy Network sued against The Ministry of Taxes in July last year. The reason is shown as penalties and sanctions of 19 billion manats for technical losses.
